A mother has been awarded a five-figure payout after her baby sustained a skull fracture while attending the nursery where she worked.
Kiera Young, 26, had entrusted her seven-month-old daughter, Lexie Hurles, to staff at Primrose City Nursery in Glasgow, where she had been employed for nearly two years.
However, during Lexie’s third two-hour settling-in session, she suffered a skull fracture and brain injury.
Baby Hospitalized Twice Following Injury
Lexie was initially hospitalized for two days before being discharged. However, she was later readmitted due to vomiting and fever. Doctors kept her under observation for another day before sending her home.
According to Kiera, Lexie continued to show signs of distress and discomfort for three months following the March 24, 2023 incident.
Conflicting Accounts & Nursery’s Denial
Kiera, who has since left her job at the nursery, claimed she received conflicting explanations from her colleagues.
One staff member said Lexie was being supervised when she threw her head back and hit the floor.
Another suggested the staff member had stepped away just before Lexie fell backward.
Unhappy with the nursery’s response, Kiera reported the incident to the Care Inspectorate, raising concerns over:
- Lack of proper care
- Delayed communication
- Absence of an accident report at the time of collection
All three complaints were upheld by the Care Inspectorate.
Legal Action & Settlement
After the nursery initially denied liability, Kiera pursued legal action through Digby Brown Solicitors. The nursery’s insurance provider ultimately agreed to a five-figure out-of-court settlement.
Kiera’s Reaction
Kiera expressed her disappointment and anger, saying: “That nursery was where I worked, so I felt safe leaving Lexie there. It wasn’t about expecting special treatment— I simply trusted the staff because I worked alongside them. It’s even worse when your own colleagues and bosses let you down like this.”
She added that she felt “horrified, terrified, and furious” upon learning about her daughter’s injury.
“I may never know exactly what happened, but what matters most is that Lexie is better, the nursery was held accountable, and hopefully, lessons have been learned.”

A Digby Brown Solicitors spokesperson stated: “The images of Lexie’s injuries are shocking— it must have been even more terrifying for both mother and daughter at the time.
“While we’re pleased that Lexie has recovered and Kiera secured justice, this should serve as a strong warning to all childcare services. Safety procedures exist for a reason, and they must be followed to ensure the well-being of children.”
