Jennifer Lopez And Ben Affleck’s Divorce Reportedly Facing Complications Due To The Absence Of A Prenuptial Agreement

According to a source who spoke with People, the couple’s ongoing divorce “has the potential to get ugly” as financial disputes have arisen between Lopez, 55, and Affleck, 52.

The two eloped at The Little White Chapel in Las Vegas but failed to sign a prenup before their marriage.

In her divorce filing, Lopez listed their separation date as April 26, 2024, and noted that their assets were “unknown.”

Under California law, only assets and income acquired during their marriage are considered “community property” and subject to division. This includes the $60.8 million Beverly Hills mansion they purchased last year, as well as several projects and endorsements they’ve undertaken since marrying.

The couple is currently in mediation, a faster and less formal alternative to traditional divorce proceedings.

According to the website of Wagner & Bloch, “Divorce mediation is an alternative dispute resolution process where a third-party mediator helps a separating couple resolve issues related to property distribution, child custody, alimony, and other divorce matters.”

Amid the divorce, Affleck appears to be adjusting well, as he moves into his new home in a neighborhood he loves. A source told People that Ben is “doing well” and focusing on the positives, especially being close to his kids. Affleck closed escrow on a $20.5 million Brentwood mansion on July 24, which coincided with Lopez’s birthday.

Meanwhile, Lopez has been house hunting since May without success, as the couple put their $68 million Crestview Manor mansion on the market.

Despite the challenges, a source revealed that Lopez is coping well, feeling “very fortunate” despite some lingering bitterness over the split. “She tried so hard to make things work, but it didn’t matter to Ben,” the insider said, noting she is surrounded by family, friends, and her children.

Lopez and Affleck legally separated on April 26, with Lopez filing for divorce on August 20 in LA County Superior Court, citing “irreconcilable differences.” Soon after the filing, rumors began circulating that Affleck was dating Kick Kennedy, daughter of RFK Jr., after they were seen together in Los Angeles. However, a representative for Affleck firmly denied the claims, stating, “There is no truth to any of it. I don’t know if they even know each other.”

Lopez and Affleck originally met on the set of Gigli in 2001, but split just days before their planned 2004 wedding. After both marrying other people—Lopez to Marc Anthony and Affleck to Jennifer Garner—they reconnected in 2021.

The couple married in Las Vegas in July 2022, followed by a larger ceremony at Affleck’s Georgia estate a month later. However, they separated earlier this year, with reports suggesting they had “planned” their divorce before Lopez’s filing in August.
