Danny Masterson agrees to give estranged wife Bijou Phillips FULL custody of their daughter

Danny Masterson has given his estranged wife full custody of the couple’s daughter.

According to documents obtained by PEOPLE, the That 70’s Show actor, 47, gave his estranged wife Bijou Phillips, 43, full legal and physical custody of their daughter Fianna, 9, with Masterson requesting visitation rights.

Request for divorce

When she filed for divorce from Masterson in September, Phillips requested legal and physical custody of their daughter, asking that she receive spousal support and to ‘terminate the court’s ability to grant support’ to Masterson.

Her request for divorce came after Masterson was sentenced to 30 years to life in prison in his rape retrial in September.

‘Ms. Phillips has decided to file for divorce from her husband during this unfortunate time. Her priority remains with her daughter,’ Phillips’ lawyer Peter A. Lauzon told PEOPLE in a statement at the time.

A jury at Los Angeles Superior Court found Masterson guilty of two counts of rape in May, per the Los Angeles Times.

After jurors deliberated for more than seven days, a third count of rape resulted in a hung jury, the outlet reported.

The filing came after Phillips was in the courtroom — alongside members of Masterson’s family — for his sentencing on Sept. 7, according to Variety.

The actor was seen blowing a kiss to his wife before being led away to prison in a court sketch.

A source told PEOPLE that the actress was ‘distraught’ over the sentencing.

The insider shared that Phillips was ‘surrounded by family and friends’ amid her husband’s legal troubles, adding, ‘She is in touch with his lawyer. They are planning appeals. She tries to stay hopeful.’
